Barbara Bagley is being allowed to sue herself for negligence after her husband died in a road accident after she lost control of the car.
Mrs Bagley, who now faces a wrongful death lawsuit, is seeking damages to cover both medical and funeral expenses along with compensation for the pain suffered by her husband, Bradley Vom Baur.
‘The insurance company refused to pay out and said she was at fault,’ said Reid Tateoka, who is acting on behalf of Ms Bagley the widow.
‘It said it was prepared to pay for the car, but it would not take responsibility for her husband.
‘She is facing funeral expenses, medical expenses and creditors.’
Barbara Bagley was driving the car across the Nevada desert when she hit a large bush. Her husband was thrown away from the car and died 10 days after the December 2011 crash.
If the court sides with her and found her negligent, she will receive compensation.
